When deciding whether to become a Host on Airbnb in Italy, it is important for you to understand the laws in your region or city. As a platform and online marketplace we do not provide legal advice, but we want to provide resources that may help you better understand applicable laws and regulations. This list is not exhaustive, but it may give you a good start in understanding your local laws.

There are three requirements for the Campania region that are applicable, whether you are a professional Host or an individual, to tourist rentals with contracts not exceeding 30 days—Communication of short-term rental activities, Codice Univoco Strutture Ricettive (CUSR), and reporting tourist data. Note: The Campania region does not consider the case of companies that intend to rent out their property for tourist purposes, without carrying out accommodation activities. In this case, we suggest you set up an “extra-hotel accommodation” (ex: holiday homes and apartments (CAV), bed and breakfast (B&B)), so that you can also offer related ancillary services (ex: breakfast).

Similarly, if you are a natural person and you want to rent your property for a period of more than 30 days, we suggest you set up an extra-hotel accommodation establishment (ex: CAV) so that you can also offer related ancillary services (ex: preparing and serving of food and drinks).

Communication of short-term rental activities

In order to rent your accommodation, you must make a specific communication to the municipality where your property is located by certified electronic mail (Posta Elettronica Certificata aka PEC).

In this communication, you must also declare that the accommodation complies with the applicable health and safety requirements and attach a copy of a valid identity document. 

Please note that you can only allocate a maximum of four property units for short-term rental.

Codice Univoco Strutture Ricettive (CUSR)

After you have sent the communication to the territorially competent municipality (check requirement 1), the same municipality will have to request a Codice Univoco Strutture Ricettive (CUSR) through the region's tourism web system.

After the municipality has entered the required data, the tourism web system automatically generates the code and sends it by PEC to your email address, which will have been duly entered by the municipal operator.

Remember that you must use the CUSR code in all promotion, marketing, and communication activities of your accommodation. Non-use, incorrect or misleading use of the CUSR is subject to a fine of €1,000 for each activity promoted, marketed, or communicated.

Reporting tourist data

For statistical purposes, you must electronically notify the Campania region of the presence of your guests through the Rilevatore Turistico Regionale platform.

Difference between tourist rentals and extra-hotel facilities

Keep in mind that tourist rental is different from extra-hotel accommodation facilities (such as CAVs, bed and breakfasts (B&Bs), etc.) for which the regional regulations on the one hand allow for the possibility of offering more services and, on the other hand, require numerous other obligations (ex: CIA, classification, etc.).
